Protection of Inheritance Rights for Children with Mental Disorders in Civil and Islamic Law

Abstract

Current civil and Islamic legal doctrines formally acknowledge the inheritance rights of individuals with mental disorders, yet a critical regulatory vacuum persists regarding subsequent guardianship oversight, exposing vulnerable heirs to predatory property alienation. This doctrinal legal research evaluated this blind spot by comparing Indonesian civil and Islamic jurisprudence against the supported decision making paradigm mandated by the Convention on the Rights of Persons with Disabilities. The analysis revealed that substituted decision making frameworks structurally fail to protect inherited assets due to the absence of mandatory early asset inventories, segregated financial accounts, and periodic judicial audits. Consequently, maintaining absolute guardianship inherently facilitates financial exploitation. To mitigate misappropriation, this study constructs an integrated oversight architecture merging the Islamic hifz al mal doctrine with international disability rights standards. This normative transformation shifts judicial institutions from passive status certifiers into active protectors of equitable wealth administration, offering prescriptive reform for global civil justice systems.
