Juridical Study of Forest Area Conversion into Agricultural Land in Tamit Village

Abstract
The systemic conversion of state forest areas into agricultural land consistently creates a severe normative tension between strict ecological conservation mandates and communal agrarian tenure rights. This research aimed to critically analyze the juridical implications of spatial redesignation utilizing a qualitative socio-legal methodology. The study found that the administrative reclassification of restricted forests into cultivable zones merely decriminalizes rural subsistence activities but remains fundamentally insufficient to guarantee absolute property rights. The central thesis asserts that mere administrative spatial legitimacy must be systematically integrated with formal land certification to definitively prevent horizontal agrarian disputes. Consequently, the execution of systematic land registration successfully transformed highly vulnerable, de facto traditional possession into absolute, de jure ownership. Ultimately, this article offers a prescriptive global model for transitional agrarian justice, proving that harmonizing spatial deregulation policies with constitutive property certification mechanisms is the fundamental prerequisite for ensuring sustainable tenure security across diverse international legal jurisdictions.
