Legal Dispute Resolution for Motorcycle Courier Drivers Facing Canceled Cash on Delivery Orders

Abstract

The rise of Indonesia's digital economy maintains high reliance on Cash on Delivery transactions. However, unilateral cancellations by consumers create a legal vacuum, transferring financial burdens to couriers. This doctrinal research utilizes statute, conceptual, and comparative approaches to analyze the multilateral legal relationship between platforms, merchants, drivers, and consumers. Findings demonstrate that drivers act strictly as mandate receivers, not sellers. Consequently, unilateral cancellations constitute an absolute breach of contract and a severe violation of good faith. Platform automated reimbursement schemes shift the actual financial loss from drivers to platforms, necessitating an immediate extrajudicial right of recourse against defaulting buyers. Drawing from the European Union Platform Work Directive, this study concludes that platforms possess a legitimate basis to execute extrajudicial sanctions. These measures include implementing permanent blacklisting integrated with advanced Know Your Customer identity systems and broader social credit scores. This mechanism proportionally deters consumer bad faith and restores legal equilibrium.
